Terms of Service

01Agreement

These Terms of Service (“Terms”) are an agreement between you and Khon Labs (“we”, “us”) about your use of the Notable Mail app and this website (together, “the Service”). By downloading, installing or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

Our Privacy Policy explains how the Service handles information and forms part of these Terms.

02What the Service is

Notable Mail is an email client for macOS. It connects to email accounts you already have with third-party providers, such as iCloud Mail and Gmail, so you can read, organize, search and send mail.

We do not provide email accounts, store your mail on our servers, or deliver messages on your behalf. Sending and storage are handled by your email provider.

03Your accounts

You may only connect email accounts that you own or are authorized to access. You are responsible for:

• keeping your Mac, its user account and your provider credentials secure;
• everything sent or done from accounts connected to the app on your Mac;
• complying with the terms and policies of your email providers.

04Email providers and other services

The Service relies on services we don’t control, including Apple’s iCloud and Google’s Gmail. Your use of them is governed by their own terms. Providers may change, limit or discontinue their services or the access they give to apps like ours, and we are not responsible for their availability, accuracy or conduct.

Notable Mail is not affiliated with, endorsed by or sponsored by Apple Inc. or Google LLC. iCloud is a trademark of Apple Inc. Gmail is a trademark of Google LLC.

05Your license to use the app

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Notable Mail on Macs that you own or control.

If you obtained the app through the Mac App Store, Apple’s Licensed Application End User License Agreement also applies. Where it conflicts with these Terms, these Terms apply to the extent permitted by Apple’s terms.

06Acceptable use

You agree not to use the Service to:

• send spam, phishing or other unsolicited bulk messages;
• break the law, or infringe or misappropriate anyone’s rights;
• access accounts or data you are not authorized to access;
• circumvent the rate limits or security measures of an email provider;
• copy, modify, distribute, sell or lease the app, or reverse engineer it, except where the law allows this despite this restriction.

07Your content

Your email and everything in it belong to you (or to whoever sent it to you). We claim no ownership of or rights to your content, and because it stays on your Mac and with your provider, we don’t have access to it.

08Actions on your mail

The app carries out your actions on your provider’s servers. When you delete, move, archive or send a message, that change syncs to your account and to your other devices. Features like Undo Send and Undo give you a short window to change your mind, but once a change has synced, it is subject to your provider’s own recovery options.

Please keep your provider’s copy of any mail that matters to you. The app’s local copy is a cache, not a backup.

09Early access and updates

Notable Mail is under active development. Features may be added, changed or removed, and pre-release builds may contain bugs. We may provide updates to fix problems, improve security or add features. Some updates may be required to keep using the Service.

10Fees

If we introduce paid features or a subscription, we will show you the price and terms before you buy, and you will not be charged without agreeing first. Purchases made through the Mac App Store are handled by Apple under Apple’s terms.

11Our intellectual property

The app, this website, and the Notable Mail name, logo and design are owned by Khon Labs and protected by law. These Terms don’t give you any right to use our trademarks.

If you send us feedback or suggestions, we may use them freely to improve the Service without any obligation to you.

12Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free or compatible with every email provider or message.

13Limitation of liability

To the extent permitted by law, Khon Labs will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, messages, profits or goodwill, arising from your use of or inability to use the Service.

To the extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence or willful misconduct, or your rights as a consumer under applicable law.

14Ending these Terms

You can stop using the Service at any time by deleting the app. We may suspend or end your license if you materially breach these Terms. Sections that by their nature should survive — such as your content, intellectual property, disclaimers and limitation of liability — continue to apply after these Terms end.

15Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the date at the top. If a change is significant, we will give you reasonable notice before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

16Governing law

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-law rules. This does not deprive you of protections given by the mandatory laws of the country where you live.
